Sexual discrimination Essay Example for Free

Sexual discrimination Essay Sexual discrimination still happens in the workplace even if it has been outlawed many years ago through the passage of the Civil Rights Act of 1964 (The U. S. Equal Employment Opportunity Commission, 2002). While a firm may not be expressly vocal about it, certain cultures prevail that snobs sexual diversity. Conley and OBarr put it that the pension funds and other financial services industries are among those that are generally intolerant to gays or lesbians. This is the dilemma facing George Campbell, an executive at financial advisory firm Kirkham McDowell Securities. George has to make a decision concerning one of its employees decision to bring his partner to a major company social event. Adam Lawson, a 29-year old associate at Kirkham, has been with the firm for two years. During this period, Adam has proven his mettle by bringing in lucrative businesses for the company, a fact that is to be acknowledged in Kirkhams silver anniversary banquet. Adam is gay and has been living with a lawyer for five years. He told George that he intends to bring Robert to the banquet. George is fearful of how the firms clients would react to the action and how it would impact the business reputation and its bottom line. Problem Identification In this situation, Georges main problem lies with how certain groups of people would react to homosexuality. First, senior management may not approve of Adam announcing to the entire assembly that he is gay. Being traditional, these people may think that being gay is unacceptable and this could hurt Adams career. Second, the companys clients include those that are also conservative and traditional, and Adams bringing of his partner to the banquet could cause them to bring their business to another firm. Third, George is worried that Adams coming out would negatively impact Kirkhams reputation in the industry. Georges fears are well founded. He knows the corporate culture as he has been with the company for many years. Even in other industries, openly supporting gay and lesbians could harm customer relationship. As example, McDonalds partnership with the National Gay and Lesbian Chamber of Commerce has been met with criticisms from traditional sectors (The Traditional Values Coalition, 2008). This is the kind of issue that George wants to avoid. Supporting Facts, Assumptions and Analysis Workplace diversity is becoming the trend in many industries (McInnes, 2000). Even a conservative one such as the banking sector recognizes the benefits and advantages of encouraging and nurturing a diverse workforce. Bank of America has a very good diversity program in place that serves the company well. This is a fact that George Campbell should face with alacrity. This is an opportunity for the firm to be a catalyst of change in an industry that is discriminating to people because of their sexuality. By allowing Adam to bring Robert to the banquet, it would give Kirkham a reputation of being a fair employee. Treating its employees fairly translates to the company being fair in its other dealings, certainly a plus factor with any client. As Woods has said, choosing the ethical way would prove beneficial to the company in the long run. While George assumes the worst, he should not discount his own reaction to Adams disclosure. He did not find it repulsive to be working with a gay person. Taking this as an example, it is highly probable that their clients and the senior management would also have the open-mindedness to accept the fact and respect Adams private issues. Being a responsible manager, Georges consideration of all issues is called for. He is weighing the issue from all angles. But as Adam puts it, the matter wont be an issue if no one would make it so. Adams talking with George about it implies that he trusts the manager to be a fair and open-minded person. It also implies that Adam knows his worth as an employee and wants to be recognized and valued for his work and not because of his private life. Best Possible Solution The obvious solution to this problem is for George to support Adams decision. It would affirm Adams trust in him and lift the worry from the associates shoulders. It is high time for Kirkham to adapt to the changing dynamics in the workplace. Losey asserts that the best managers would take this action. Adam is a valuable asset to the company and Kirkham should not let his sexual orientation get in the way. Besides, Adams five-year partner is a respectable lawyer who could probably send clients their way. Also, if Adam wont be allowed to bring Robert, he would feel the discrimination deeply and this could result to his resignation from the company. Since Adam had come to Kirkham at 27, it is likely that he left his previous employer because of sexual discrimination. If this will be the ending, Adam could move to another company and bring with him his clients. Feasibility of Solution George is definitely taking a risk by openly supporting Adams sexuality. There are two probable results to the solution. The first one would make Georges fears come true. The firms most conservative clients would frown at the change and bring their business elsewhere. However, other firms could also be shifting their paradigms to embrace diversity, forcing the conservative clients to adapt. The second result would allay Georges fears. The clients would not mind dealing with a company that chooses to be legally and ethically correct. Should this happen, Kirkham would be bringing change not only to its offices but to other companies as well. Between the two, the second is more likely to happen as managers and companies understand the need to empower the workforce. One way of doing this is to encourage diversity in whatever form. The traditional and conservative clients may not be a hundred percent sold to the idea but it would be willing to tolerate a firm that produces good results.

Lucy V. Zehmer Supreme Court of Appeals of Virginia Essay Example for Free

Lucy V. Zehmer Supreme Court of Appeals of Virginia Essay FACTS:W.O. Lucy, the plaintiff, filed suit against A.H. and Ida Zehmer, the defendants, to compel the Zehmers to transfer title of their property known as Ferguson Farm to the Lucys for 50,000$ as the Zehmers ad allegedly agreed to do. The families had known each other for many years and the Lucys had tried to buy the facility countless times, but to no appeal. After a night of drinking and badgering, W.O. Lucy was able to entice Zehmer into writing up an agreement that stated Zehmer would sell Ferguson Farm to Lucy for 50,000$. Later, Lucy sued Zehmer to compel him to go through with the sale. Zehmers argument centered on him being drunk and that the agreement was in jest hence the agreement was unenforceable. The trial court agreed with Zehmer, Lucy appealed. ISSUE:If a contract is signed by both the defendant and plaintiff parties, would the contract be considered unenforceable if one of the parties considers the writings in jest? DECISION:No. The Supreme Court of Appeals of Virginia reversed the rulings of the lower court saying that the writing was an enforceable contract. REASON:The court acknowledged that the writing was a contract. The fact that it was under consideration for forty or more minutes before it was signed. The fact that Lucy objected to the first write up because it was written in the singular; the discussion as to what was to be included in the sale, the provision for the examination of the title, the completeness of the instrument that was executed. The taking possession of it by Lucy without request or suggestion by either defendant that he give it back, are facts that show that the execution of the contract was a serious business transaction rather than a casual one. BASIC TECHNOLOGY CORPORATION v. AMAZON Appeals Court of Massachusetts, 71 Mass.App.Ct. 29,878 N.E.2d (2008). FACTS:Basis Technology Corporation, the plaintiff, filed suit against Amazon.com, Inc. The plaintiff company was responsible for creating software and provided technical service for Amazons Japanese-Language Website. Their agreement allowed for separately negotiated contracts so that the plaintiff company could provide additional services for Amazon. In 1999, the two entities entered into stock purchase agreements. Amazon later objected to securities that Basis sold. Basis sued for various claims including the securities and for failing to pay for additional services Basis provided that weren’t in the original agreement. During trial, it seemed as if the parties had settled based off a series of e-mails but Amazon reneged and the trial judge ruled against Amazon, which then appealed. ISSUE:Can a settlement be reached, and then be broken by only one party even if the two parties were bounded by such a settlement? DECISION:Yes. The Appeals Court of Massachusetts affirmed the trial courts finding that Amazon intended to be bound by the terms of the March e-mail. It constituted a complete and unambiguous statement of the parties’ desire to be bound by the settlement terms.

The Bangladesh Liberation War, 1971

The Bangladesh Liberation War, 1971 India Pakistan War 1971 also known as Bangladesh Liberation War was as armed conflict between India and East Pakistan against West Pakistan. The war resulted in massive defeat of West Pakistan and secession of East Pakistan which is now known as Bangladesh. The war broke out on November 14 1971, initially engaging East Pakistan and West Pakistan, and later joined by India after attack of West Pakistan on the Indian Air Bases on December 3rd 1971. The war lasted until December 17th 1971. The cultural difference, economic exploitation, and language controversy between East Pakistan and West Pakistan led to separatist movement in East Pakistan. The army of West Pakistan launched Operation Searchlight to crush the movement. The massacre of thousands of civilians in East Pakistan was the main cause of the war. This research paper examines the study of the major combats and tactics used by both militaries. India and Pakistan got freedom from British rule and became separate nations in August 1947. Since then they fought many wars. In the year of 1971, East Pakistan which was the part of Pakistan earlier started protesting against the policy of the Pakistani Government. Pakistani failure to accommodate demands for autonomy in East Pakistan led to a separatist movement. West Pakistani Government launched fierce campaign called Operation Searchlight to crush the separatist movement. In 1971 West Pakistani Army carried out genocide in East Pakistan. Millions were killed and about ten millions refugees fled to India during the genocide. India already suffering from humanitarian and economic crisis was not able to carry burden of 10 million refugees. India started aiding to the Liberation Army of East Pakistan also called as Mukti Bahini to make East Pakistan an independent state and restore those refugees back to their homeland. This way the war in Eastern Theater started engaging Indian Mi litary, West Pakistani Military and Liberation Army. To release the pressure from the soldiers fighting in the East Pakistan and, to draw worlds attention away from the Genocide, West Pakistani Air Force attacked Indian Air Bases on December 3rd 1971. After the attack, India officially entered into war with West Pakistan. December 3rd 1971, 5.45 pm in evening, Pakistan launched massive attack against India by bombing Indian Airfields at Amritsar, Pathankot, Srinagar, Avantipur, Uttarlai, Faridpur, Chandigarh, Ambala and Agra. Pakistans main intention was to carry out massive air attack like the one that Israel carried out against Egypt in 1967 destroying Egyptian Air force completely. It was pre-emptive strike to destroy the Indian Air Force (IAF) completely before launching massive ground attack. The Pakistani Air Force (PAF) plane came in formation of 2, 3 and 6 and could not cause any irreparable damage to Indian planes or to Runway. Pakistan Air Force didnt succeed because of the simple reason that the Israeli plan that was studied and rehearsed by PAF was also studied by IAF. So the Pakistani attack on Indian Air bases was partially known to IAF thats why IAF took necessary caution for such kind of attack. The Indian command had dispersed most of its war planes from the forward air field to the interior areas which were away from the normal range of Pakistani Bombers. IAF took the precaution of hiding their planes inside the concrete pens so that only direct hit can destroy the plane. Almost all the Indian airfields were protected by the ack-ack anti aircraft guns hidden under the camouflaged netting. In response to Pakistani attack, Indian Air Force planes took off for Pakistan at the midnight 12.30 Am on December 4th 1971. Indian bombers attacked almost all Pakistani air fields in the West within 5 hour of taking to the air. IAF flew 500 sorties on the first night of attack. IAF flew equal amount of sorties in east and west but did more damage in East Pakistan. IAF destroyed half of the strength of PAF in east and PAF was left with only 9 Sabre Jets in the east. On 6th December 1971 IAF carried out 120 sorties for ground attack only. The IAF airman went to Attock to bomb Pakistani Refinery. Along with that, they destroyed eight railway station carrying military supplies and ammunitions and 22 wagons of goods train. IAF destroyed Pakistani target such as Bridges, Petrol Pumps, tanks, armored vehicles etc. IAF pilots carried out attacks on the PAF airbases at Mianwali, Murid,Sargodha, Sharkot, Chander and Risawala. During the 14 Day war period, IAF flew some 4000 stories in the we st and 2000 in the East.IAF also helped ground troops in many ground battles. In the Western Theater of war, the Indian Navy under the command of Vice Admiral Kohli achieved success by attacking Karachis port in the code named Operation Trident on the night of 4-5 December. Pakistani Naval headquarters was based at the historic and strategic port of Karachi here almost their entire fleet was concentrated. Pakistan attacked on Indian Airbases on December 3rd so it wasnt possible to carry out attack on the same night for Indian Navy. The attack was planned for the night of 4-5th December which was to be coordinated by continuous aerial bombardment from the IAF. The first attack on Karachi was to be undertaken by the Killer squadron which had these three missile boats; INS Nipat, INS Nirghat and INS Veer later accompanied by INS Kiltan and INS Vidyut. The fleet moved closer to the Pakistani land in the darkness of night. When the fleet was 70 miles away from Karachi, the squadron commander (K-25) B.B Yadav detected a contact at a distance of about 45 miles and a second contact about 42 miles northeast. That was the Pakistani destroyer Khaibar which failed to receive orders on investigation possible contact south of Karachi. K-25 ordered INS Nirghst to handle the contact in northwest. When INS Nirghat saw destroyer coming straight at the force, it launched a missile. When Khaibar saw a bright light approaching her they open fir anti aircraft gun mistaking it to be an aircraft. The missile struck Khaibar and exploded below the aft galley about 22.45hrs Pakistani time.

Scarlet Letter Essay + :: essays research papers

Throughout life we all will be faced with hypocrites or have the choice to be true to ourselves or to deceive ourselves. Especially as a Christian you may wonder if people look at you as a hypocrite and should also strive to not be one. Of course, the most important part is to be true to yourself because only then may you be true to God and to others. Nathaniel Hawthorne also shows this in The Scarlet Letter through the characters he portrays. In chapter 20, Hawthorne writes, “No man, for any considerable period, can wear one fact to himself and another to the multitude, without finally getting bewildered as to which may be true.'; Hiding the truth from others just confuses life and oneself. Hawthorne often focuses on the point that truth reveals itself. For instance, Hester Prynne was quite aware of the fact that truth will be revealed. She was forced to wear a scarlet “A'; on her bosom, which stood for adultery, for her entire life. Truth was revealed to Hester by the fact that she became pregnant with a child as a result of her sin. Pearl noticed her mother’s scarlet A as a baby and was attracted to it instantly for some reason. Pearl notices the letter as an infant as her “eyes had been caught by the glimmering of the gold embroidery about the letter, and, putting up her hand, she grasped at it…';(98) and Hester feels the “torture inflicted by the intelligent touch of Pearl’s baby hand.'; (98). This seems to suggest that truth was once again revealed to Hester whenever Pearl noticed the scarlet letter and it shows how Pearl seemed to know the significance of the letter as an infant. While Hawthorne shows how truth revealed itself to Hester he shows a different way that truth was revealed to Reverend Arthur Dimmesdale. At the beginning of the novel Dimmesdale seems to be doing a good job of keeping his secret to the whole town who respects him immensely. Although in the first chapter Reverend Dimmesdale argues on Hester’s behalf the town seems to think nothing of this other than that he is trying to not judge her. As the new doctor in town Roger Chillingworth befriends Reverend Dimmesdale. Chillingworth notices a scarlet letter of guilt on the Reverend’s chest and soon begins to take his revenge. The doctor who plays on the Reverend’s guilt increases Dimmesdale’s torment.

â€Å"Beauty is only skin deep.† Everyone knows the quote, yet why is it that we still struggle to look our best? Why is it that some women bother to wake up an hour early to do their hair and makeup? Its simple etiquette, some might argue. However, etiquette aside, why is it that twenty million people in America alone suffer from eating related disorders? Why is it that a 38 inch plastic doll is a little girl’s role model? This is why (visual aid). Magazines, movies, newspaper advertisements, the internet. All of these tend to showcase seemingly thin, beautiful, toned models and celebrities, causing many women in the world to be pressured to have the ‘perfect’ body image, never satisfied with their own bodies and looks and willing to do anything to achieve the ideal image, even if it means having to subject themselves to dieting, hunger and eating disorders. Now, what should blame for this unhealthy obsession that has bloomed among today’s wom en? Of course it would have to be the media. Don’t get me wrong, there are definitely other causes of eating disorders, but with constant advertising and material showcasing visuals that feature seemingly flawless and thin women, who would not feel insecure? Who would not feel influenced to want to have a similar body image? The very image of the ‘ideal’ woman has caused many women around the world to place outer appearance on a pedestal, to hate their own image, and ultimately fall victim to terrible eating disorders. My name is Valerie, and the purpose of my speech today will be to convince you that the portrayal of a woman’s body image by the media is the root cause of eating disorders and self esteem issues among women and girls today and thus implore your support in getting the media to stop... ...ing is very wrong. Today I have gone over three main points to aid me in persuading you of my cause against this unhealthy promotion of an unattainable body image by the media: The highly negative effects on body image caused by the media, the ways the media promotes an unhealthy, unattainable body image of a woman as the ‘perfect’ and ‘ideal’ image, and last but definitely not least, how the emulation of this sort of body image can be prevented. With that, I do hope I have managed to convince you that the portrayal of a woman’s body image by the media is the root cause of eating disorders and self esteem issues among women and girls today and thus implore your support in getting the media to stop airbrushing and promoting these unattainable images of perfection. Everyone deserves to feel beautiful. The eradication of the pressure to be perfect begins with the media.

Greek Mythology Newspaper Headlines

Hello, this is the most exquisite goddess of love and beauty, here to do my beloved job of creating love. So, this week we have advice for the lovely queen of the gods as she requested, but as she would rather not have her true name revealed, she asked to be called CheatedWife1 instead. Now, CheatedWife1, you have come to me saying that your husband Zeus, king of the gods, is a cheater and is always fraternizing with other women, mortal and divine. I must say, this is quite a sad revelation! Well, my advice to you is to try to catch these consorts, and show them just who is queen of the gods and rightful consort of Zeus! That’s it for today so see you next week with another section of advice! May love find you quickly! -AphroditeOlympus NewsThis week on Olympus, we have visiting the mortal Hercules, who will be attending the company of Lady Hera, as he was summoned. Hercules has been a wonder to the mortals, and a source of revenge for the Lady Hera because her husband Zeus is his father, and she isn’t the mother. His many extraordinary feats include: slaying the Nemean Lion, slaying the Hydra, capturing the Erymanthian Boar, slaying the Stymphalian Birds, capturing the Cretan Bull, obtain the cattle of the monster Geryon, steal the apples of the Hesperides, capture and bring back Cerubus, and many more so make sure to respect this mighty hero! Mortal NewsThis week the mortals have been involved in yet another war, one they call the Trojan War because the opposing sides are the city of Troy and the Greeks. Troy had managed to hide behind its high and protective walls for a long while, but eventually the Greeks broke through by sending a small force in the guise of a large wooden horse that they hid inside, then from there allowed the rest of their army entry and took down Troy. It has been confirmed that divine interference was the base cause of this war, although names will not be said in order to avoid a godly war. In other news the demigod Pers eus has managed to slay the hideous gorgon Medusa and take her head, a marvelous victory, for a mortal.SportsAs many of us gods and goddesses are already aware, the Olympic Games are approaching. The mortals have made this a religious event, and will pray to us for our help, but just a reminder: we must not interfere with these games as they are dedicated to Mighty Zeus and so he has decreed such. These games started with finding a priestess for the Lady Hera, but eventually became the event that involves both the mortals and us deities.
